Terms of Service

Welcome to TGKW (天工开悟). These terms are an agreement between you and TGKW ("we", "us") about your use of the tgkw.ai website, the TGKW desktop client and related online services (together, the "Service"). By registering for or using the Service, you agree to these terms and our Privacy Policy.

1. The Service

TGKW is a browser with a built-in AI assistant. You can browse in multiple isolated browser environments and give tasks to the AI: browsing and operating web pages, organizing data, reading or writing data in third-party services you connect, generating images, and running saved workflows on a schedule. Features are as provided in the client and may be changed, added or retired.

2. Accounts

• Provide accurate registration information and keep your credentials secure. Actions taken with your account are treated as your own.
• Contact us immediately if you believe your account has been compromised.
• Members of an organization account are managed by its administrator, and the organization is responsible for its members' use.

3. Connecting third-party services

• Connectors use authorizations you obtain from third-party platforms. You must have the right to let us access those accounts and data on your behalf, and you must follow the rules of those platforms.
• We access these services only when a task you give the AI requires it. Sending email, writing data and actions that incur charges require your confirmation every time; actions you confirm are treated as your own.
• We do not control third-party services, their availability, API changes or actions they take on your account, and are not liable for resulting unavailability, though we will try to adapt.

4. Acceptable use

You must not use the Service to:

• break the law or infringe others' intellectual property, privacy or other rights;
• access others' accounts, systems or data without authorization, or bypass access controls and security measures;
• scrape at scale, mass-register accounts, send spam, or otherwise disrupt websites and platforms;
• generate unlawful or infringing content, including product images that misuse others' brands or trademarks;
• reverse engineer, resell or otherwise use the Service beyond what these terms allow.

We may suspend or terminate features or accounts used in violation of these terms.

5. AI-generated content

• AI answers, organized data and generated images may be inaccurate or incomplete. Verify them yourself before making important decisions about prices, inventory, orders or legal compliance.
• To the extent permitted by law, content you generate with the Service belongs to you, and you are responsible for how you use it, including making sure it does not infringe others' rights before using it commercially.
• Infringement checks only indicate risk and are not legal advice.

6. Fees

Some features (such as AI image generation and model usage) are charged by usage or included in plans. Prices are as published in the client and on our website; actions that incur charges show the estimated cost before they run. Consumed usage is non-refundable except where required by law.

7. Intellectual property

The software, interface, the "天工开悟" trademark and related content belong to us or their respective owners. We grant you a limited, non-transferable license to use the Service under these terms.

8. Disclaimers and limitation of liability

• The Service is provided "as is". We work to keep it reliable but do not guarantee it will be uninterrupted or error-free.
• We are not liable for losses caused by your instructions, actions you confirm, third-party services or force majeure.
• To the maximum extent permitted by law, our total liability to you is limited to the fees you paid us in the 12 months before the loss occurred.

9. Termination

You may stop using the Service and request account deletion at any time. We may stop providing the Service to you if you seriously breach these terms. After termination we handle your data as described in the Privacy Policy.

10. Changes

We may update these terms and will post the new version on this page; we will notify you of material changes through the client or by email. Continuing to use the Service after an update means you accept the updated terms.

11. Governing law and disputes

These terms are governed by the laws of the People's Republic of China. Disputes shall first be resolved through friendly negotiation; failing that, either party may bring a lawsuit before the competent people's court where we are located.
